Section 138
<br> not to produce explosives
No person shall manufacture, prepare or produce any kind of explosive substance without obtaining a license or even if he has obtained a license in contravention of the conditions and restrictions mentioned in the license. Explanation: For the purposes of this Code:-
(a) “explosive device” means an IED capable of detonating and causing damage; TNC Amatol, Barotol, Pentolite, Rapid Destructive Explosive (RDX), Tor Fax, Blastic Explosive, Dynamite, Gunpowder, Nitroglycerin, Gelignite, Stemite, Celcite, Detonator, Blast Cap, Electric Blast Cap, Fuse, Firecracker, Firecracker, Gun Cotton, gun powder, blasting powder, mercury (mercury) or any other metal fulunate, any other explosive substance of the same nature or any substance specified by the Government of Nepal by publishing a notice in the Nepal Gazette, and the term also refers to a bomb.
(b) "Bomb" means an explosive substance or any other device, formula, process or means made to detonate by itself or by any other substance, a grenade or any other explosive substance of a similar nature.
(2) A person who commits or causes an offense under sub-section (1) shall be punished as follows:-
(a) Imprisonment up to ten years and fine up to one lakh rupees in case of high explosive substance,
(b) imprisonment for up to five years and fine up to fifty thousand rupees for soft explosives (low explosives),
(c) Imprisonment for a term which may extend to three years and fine which may extend to thirty thousand rupees, in case of ordinary explosives,
(d) Anyone who manufactures, uses, keeps or does any other business with explosives production or manufacturing mechanism, machine or weapon shall be imprisoned for two years and fined up to twenty thousand rupees.
(3) “hard explosive” means dynamite, nitroglycerin, T.N.C., gelatine, mercantile lava, fulunate of mercury, R.D. X, Amatol, Barotol, Pentolite, Stemite, Celcitel, Blastic explosive bombs and other explosives of a similar nature.Should be.
(4) "Soft explosives" means blasting powder, gun powder, gun cotton, mercury, gunpowder or fulunate of any other metal and other explosives of a similar nature.
(5) "Ordinary explosives" means detonators, blasting caps, electric blasting caps, fumes, firecrackers, firecrackers and other explosives of a similar nature.
